Hearty
Wishes stipulates the following terms and conditions and all the customers
who place orders with Hearty Wishes are deemed to have accepted all our
terms and conditions. The terms are mentioned only to ensure smooth and
effective service and not to cause any inconvenience to our customers.
1. Hearty Wishes
fully understands the importance of timely delivery of the products to
the recipients in India. As these products represent an expression of
affection, every care will be taken to ensure the timely delivery of the
product in the normal course. However if the delivery could not be completed
due to the non availability of the recipient at the given address due
to one reason or the other, Hearty Wishes does not accept any responsibility
for the non delivery. In such cases, the customer should treat this transaction
as completed. However, Hearty Wishes undertakes to deliver the goods other
than perishable goods to the recipient at the earliest occasion. But the
order will be charged for the entire services rendered.
2. Hearty Wishes will undertake utmost care in choosing the products,
but Hearty Wishes is not involved in the making of any of these products.
Hearty Wishes will supply the products from reputed manufacturers. In
case of items like cakes, sweets etc., attention would be paid to hygiene,
quality and method of packing. In case of products like watches, mixies,
grinders, cookers etc., the manufacturers take the responsibility for
the quality and performance of the respective products. Hearty Wishes
does not give any warranties for the performance of the products excepting
the warranties issued by the respective manufacturers.
3. The responsibility of Hearty Wishes ends with the delivery of the products
intact to the recipients. For any defects found in the performance of
any product, the recipient will have to take up the matter with the respective
showroom and Hearty Wishes will not be entertaining any requests for service/repair.
4. All the prices listed are inclusive of all taxes and they are quoted
in US Dollars. However shipping charges are to be added to the total cost

5. In order to ensure the timely delivery of the selected products, the
customers are requested to send the orders at least 72 hours before the
event along with the complete postal address, mail address(if any), telephone
number of the recipient.
6. As soon as an order is received, Hearty Wishes will proceed with the
procurement of various products as listed in the order. Simultaneously
arrangements for packing and shipping are also done. However if the delivery
of the products is delayed because of reasons which are beyond Hearty
Wishes control and due to factors like BANDH, HARTHAL, Transport strike
and other such unforeseen circumstances which paralyze normal way of life,
the customer understands the reasons for the delay and absolves Hearty
Wishes for the delay/damage in the delivery of the products.
7. Orders once placed can not be cancelled and any proposed changes in
the order must be notified by the customer within 3 hours after submitting
the order. Hearty Wishes will make sincere efforts to incorporate the
changes but Hearty Wishes will not be held liable if such changes are
not carried out.
8. Hearty Wishes will deliver exactly the same products displayed on its
website and from the sources indicated. However, in case of non availability
of products from the indicated sources Hearty Wishes reserves the right
to change the source and deliver approximately similar kind of product.
If similar kind of product is not available, Hearty Wishes will seek fresh
instructions from the customer.
9. It is the earnest desire of Hearty Wishes to execute every order strictly
as per the choice of the customer. However in cases where Hearty Wishes
feels that a particular perishable gift is bound to spoil before reaching
the destination due to distance, climate etc. Hearty Wishes reserves the
right to replace the perishable gift item with a less perishable gift
item.
10. In case of non-delivery of the products to the recipients due to their
non-availability, Hearty Wishes will make sincere and earnest attempts
to trace them and deliver the goods. However, in cases, where we are not
successful in locating the recipients after reasonable search, the order
will be still treated as executed. In all such cases, Hearty Wishes will
be charging 100% for the perishable goods and at the rate of 25% for non-perishable
goods and Hearty Wishes will arrange for the refund accordingly.
11. Hearty Wishes deserves the right to change the terms and conditions
of the service or policies regarding the use of the service, at any time
and such changes are notified by an updated version of the terms and conditions
of our service on our web site. You are suggested to review the terms
and conditions of service regularly. Continued use of this service after
any such changes shall constitute your consent to such changes. All the
customers who place orders with Hearty Wishes are expected to be familiar
with the above terms and conditions and when an order is placed, it is
deemed that they have accepted the above terms and conditions in total.
12. In the unlikely event of a dispute relating the service of Hearty
Wishes, all such disputes shall be subjected to the jurisdiction of a
court in GUNTUR, AP, INDIA.
